Abstract

This lecture analyzes and discusses the barriers to family law enforcement in Morocco. It will focus on the Sixteen years after the 2004 reform and highlight new perspectives and challenges. Based on Slaoui (2015) in which a historical excursus of the Moroccan family code was provided whereby it was shown that Mudawwanat al-aḥwāl al-shakhṣiyya (Personal status code), sought to find the balance between traditional Islamic law and modernized family law, the main research questions to be addressed in this study are: What is the current situation of the New Family Law in Morocco? What are the main challenges that stand against the enforcement of the Family Law? How is Covid-19 exacerbating gender inequality? It will be argued that the many faces of feminism in Moroccan society, which vary from Secular Feminism to Islamic Feminism, including both the differences and similarities of these approaches, will certainly play a substantial role in changing the situation and overcoming the challenges facing up the Mudawwanat al-usra (Family Law).
